TERMS OF USE (DISTANCE AGREEMENT)

Rozentāls Jelgava district farm “KRASTIŅI”, registration no. 41701004855, VAT number LV41701004855, legal address: “Krastiņi”, Lielplatones pag., Jelgavas nov., LV-3022, hereinafter referred to as the online store, provides the content available on the website and provides goods in accordance with the Terms of Use set out below.

1. General provisions

If a consumer purchases goods through the website, then such a mutual agreement is considered a Distance Contract and is subject to the legal provisions of the Republic of Latvia that regulate distance contracts, including, but not limited to, the "Consumer Rights Protection Law" of the Republic of Latvia, the regulations of the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contracts", etc.

2. Making purchases

The prices and specifications of the products sold in the online store are indicated next to the products. To place an order, add the desired products to the shopping cart. Fill in all the required fields and select the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make the payment for the purchase to complete the order.

3. Payment terms

The payment currency on the website is euros (€). You can pay for your purchase using the MakeCommerce payment platform (Maksekeskus AS):

Latvian internet banking payments: Swedbank, SEB, Citadele un Luminor

Visa/Mastercard card payments

Using the online banking payment method, confirm the order and click the "Return to merchant" button.

Personal data required for payment processing is transferred to a licensed payment institution Maksekeskus AS. The contract comes into force upon successful payment to the online store's bank account. If for any reason it is not possible to fulfill the order, the Buyer will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after receipt of the notification.

4. Delivery terms

The goods are delivered to the Republic of Latvia and other Baltic countries. The purchased goods are delivered using Omniva parcel machine network.

Shipping costs are displayed before the order is confirmed. Purchased goods are delivered to the pickup point or address specified by the Buyer. Within 2–5 business days from the moment of receipt of payment. In exceptional cases, we have the right to send the goods up to 45 calendar days, informing the customer in advance.

5. Right of withdrawal and exceptions

According to the Cabinet Regulation No. 255 “Regulations on distance contracts”, paragraph 22.4., The right of withdrawal does not apply to goods that are perishable or food products (including fresh garlic and other agricultural products).Due to safety, hygiene and product perishability/weight changes, food items are not accepted for return and are not subject to exchange or refund.

If the received product is damaged during transportation or does not match the order, the Buyer is obliged to contact the Seller. Within 24 hours from the moment of receipt, sending photos to e-mail info@kiploks.lvto agree on a solution to the situation.

6. Consumer rights regarding goods not conforming to the contract

The online store is responsible for the non-compliance of the goods sold to the Buyer with the terms of the contract or for defects that arose at the time of delivery of the goods or within the period specified by law. The Buyer must inform the Seller of the non-compliance of the goods immediately, within 2 months of its detection, by contacting us by e-mail info@kiploks.lv.

The online store is not responsible for defects that have arisen after the goods have been delivered to the Buyer due to improper storage or use. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the removal of the defects or exchange for new goods free of charge. Pārdevējs uz patērētāja sūdzību sniedz rakstisku atbildi 15 dienu laikā.

7. Processing of the Buyer's personal data

The online store processes only the personal data that the buyer has entered when ordering goods (for example, name, surname, delivery address, phone number, e-mail). The online store transfers personal data to transport service providers (Omniva, etc.) to ensure the delivery of goods, as well as to the payment institution Maksekeskus AS to execute the transaction.

8. Dispute Resolution Procedure

All disputes arising between the Seller and the Buyer shall be resolved by the parties through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations, the dispute shall be resolved in the court of the Republic of Latvia, in accordance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may also be submitted for resolution to the Consumer Rights Protection Center (PTAC) or using the European Union Online Dispute Resolution (ODR) platform.
